If personal data is processed by individual cookies we use, the processing is based on Article 6(1)(b) of the GDPR for the performance of a contract, on Article 6(1)(a) of the GDPR in case of your consent, or on Article 6(1)(f) of the GDPR for the purpose of safeguarding our legitimate interests in the best possible functionality of the website and a user-friendly and effective design of your visit. When contacting us (e.g., via contact form or email), personal data will be processed solely for the purpose of processing and responding to your inquiry, and only to the extent necessary.

7 User Generated Content

If you choose to submit user generated content to any public area of the Services, this content will be public and accessible by anyone. We do not control who will have access to the information that you choose to make available to others, and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available, or for the accuracy, use or misuse of any information that you disclose or receive from third parties.

As part of the comment function on this website, in addition to your comment, information about the time of the comment's creation and the commentator name chosen by you will be stored and published on this website. The legal basis for storing your data is Art. 6(1)(b) and (f) of the GDPR. We reserve the right to delete comments if they are objected to as unlawful by third parties.

8 Subscription to Our Newsletter

On our website, users have the option to subscribe to our company's newsletter. The personal data transmitted to the data controller when ordering the newsletter is determined by the input mask used for this purpose.

We regularly inform our customers and business partners about company offers through newsletters. The newsletter can only be received by the individual concerned if (1) the individual has a valid email address and (2) the individual has registered for newsletter delivery. To comply with legal requirements, a confirmation email is sent in a double opt-in process to the email address initially provided by the individual for newsletter delivery. This confirmation email verifies whether the email address owner, as the individual concerned, has authorized receipt of the newsletter.

When subscribing to the newsletter, we also store the IP address assigned by the Internet Service Provider (ISP) to the computer system used by the individual at the time of registration, as well as the date and time of registration. The collection of this data is necessary to trace any potential misuse of the individual's email address at a later time and serves as legal protection for the data controller.

The personal data collected during newsletter registration is exclusively used for newsletter distribution. Additionally, subscribers to the newsletter may be informed via email if this is necessary for the operation of the newsletter service or related registration, such as in the case of changes to the newsletter offering or technical circumstances. The personal data collected as part of the newsletter service is not disclosed to third parties. The subscription to our newsletter can be terminated by the individual concerned at any time. The consent to store personal data provided by the individual for newsletter delivery can be revoked at any time. Each newsletter contains a corresponding link for the purpose of revoking consent. Furthermore, it is also possible to unsubscribe directly on the website of the data controller or to communicate this to the data controller by other means.

9 Sending  email newsletters to existing customers

If you have provided us with your email address when purchasing goods or services, we reserve the right to regularly send you offers for similar goods or services from our range by email. In this regard, we are not required to obtain separate consent from you in accordance with § 7(3) of the German Act Against Unfair Competition (UWG). The data processing is based solely on our legitimate interest in personalized direct advertising pursuant to Art. 6(1)(f) of the GDPR. If you initially objected to the use of your email address for this purpose, we will not send any emails for advertising purposes.

You have the right to object to the use of your email address for the aforementioned advertising purpose at any time with effect for the future by notifying the data controller mentioned at the beginning. You will only incur transmission costs according to the basic rates. Upon receipt of your objection, the use of your email address for advertising purposes will be discontinued immediately.

10 Newsletter Tracking

We use Mailchimp as our newsletter service provider. Mailchimp is a service provided by The Rocket Science Group LLC, located in the United States. Your email address and other information you provide when subscribing to our newsletter will be stored on Mailchimp's servers. Mailchimp uses this information to send and analyze our newsletters on our behalf. For more information about Mailchimp's privacy practices, please refer to their Privacy Policy. By subscribing to our newsletter, you acknowledge that your information will be transferred to Mailchimp for processing in accordance with their Privacy Policy and Terms.

Our Newsletter contains tracking pixels. A tracking pixel is a miniature graphic embedded in HTML-format emails to enable log file recording and analysis. This allows for statistical evaluation of the success of online marketing campaigns. By means of the embedded tracking pixel, Gebrüder Bee GbR can recognize whether and when an email was opened by an individual concerned and which links contained within the email were clicked on by the individual concerned.

The personal data collected through tracking pixels in the newsletters is stored and evaluated by the data controller to optimize newsletter distribution and better tailor the content of future newsletters to the interests of the individual concerned. This personal data is not disclosed to third parties. Individuals concerned have the right to revoke their separate consent given through the double opt-in process at any time. After revocation, this personal data will be deleted by the data controller. Unsubscribing from receiving the newsletter is automatically considered a revocation by Gebrüder Bee GbR.

11 Use of customer data for direct marketing

If you subscribe to our email newsletter, we will regularly send you information about our offers. The only mandatory information for sending the newsletter is your email address. Providing additional data is voluntary and will be used to address you personally. For sending the newsletter, we use the double opt-in procedure, which ensures that you only receive the newsletter if you have expressly confirmed your consent to receive the newsletter by activating a verification link sent to the email address provided.

By activating the confirmation link, you give us your consent to use your personal data in accordance with Art. 6(1)(a) of the GDPR. In this process, we store the IP address entered by the Internet service provider (ISP) as well as the date and time of registration in order to trace any potential misuse of your email address at a later time. The data collected during the newsletter registration will be used strictly for the intended purpose.

You can unsubscribe from the newsletter at any time using the link provided in the newsletter or by sending a corresponding message to the data controller mentioned at the beginning. After unsubscribing, your email address will be immediately deleted from our newsletter distribution list, unless you have expressly consented to further use of your data or we reserve the right to use the data beyond that, which is permitted by law and about which we will inform you in this statement.

12 Advertising by postal mai

Based on our legitimate interest in personalized direct marketing, we reserve the right to store your first and last name, postal address, and - if we have received this additional information from you during the contractual relationship - your title, academic degree, year of birth, and professional, industry, or business designation in accordance with Art. 6(1)(f) of the GDPR, and use them to send you interesting offers and information about our products by postal mail.

You can object to the storage and use of your data for this purpose at any time by contacting us.

13 Data processing for order processing

To the extent necessary for the fulfillment of the contract regarding delivery and payment, the personal data collected by us will be transferred to the commissioned shipping company and the commissioned credit institution in accordance with Art. 6(1)(b) of the GDPR.

If, based on a corresponding contract, we owe you updates for goods with digital elements or for digital products, we process the contact data (name, address, email address) provided by you during the order to inform you personally about upcoming updates within the legally prescribed period, in accordance with our legal obligations under Art. 6(1)(c) of the GDPR, using an appropriate communication channel (e.g., postal mail or email). Your contact data will be strictly used for notifications regarding updates owed by us and will only be processed by us to the extent necessary for the respective information.

In order to process your order, we also collaborate with the following service provider(s) who assist us, either wholly or partially, in the execution of concluded contracts. Certain personal data will be transmitted to these service providers as per the following information.

To fulfil our contractual obligations to our customers, we collaborate with external shipping partners. We only share your name, delivery address, and, if necessary for delivery, your phone number with a shipping partner selected by us for the purpose of delivering the goods, in accordance with Art. 6(1)(b) of the GDPR.

14 Transfer of personal data to shipping service providers

* GLS

As a transportation service provider, we work with the following company: General Logistics Systems (GLS), General Logistics Systems Germany GmbH & Co. OHG, GLS Germany-Straße 1 - 7, 36286 Neuenstein, Germany

We will share your email address and/or phone number in accordance with Art. 6(1)(a) of the GDPR with the shipping provider prior to delivering the goods, for the purpose of coordinating a delivery schedule or providing delivery notifications, if you have explicitly consented to this during the ordering process. Otherwise, for the purpose of delivery, we will only share the recipient's name and delivery address with the provider in accordance with Art. 6(1)(b) of the GDPR. The disclosure will only be made to the extent necessary for the delivery of the goods. In this case, prior coordination of the delivery schedule with the provider or delivery notifications will not be possible.

The consent can be revoked at any time with future effect by notifying the responsible party mentioned above or the provider.

15 Transfer of personal data to Payment service providers

* Klarna

We use Klarna as a payment provider on this website. Klarna is an online payment service provider that enables purchases on account or flexible installment payments. Klarna also offers additional services such as buyer protection and identity and credit checks.

The operating company of Klarna is Klarna Bank AB, Sveavägen 46, 111 34 Stockholm, Sweden. If the data subject selects "purchase on account" or "installment payment" as a payment option during the ordering process in our online shop, data of the data subject will be automatically transmitted to Klarna. The personal data transmitted to Klarna usually includes first name, last name, address, date of birth, gender, email address, IP address, telephone number, mobile phone number, and other data necessary for processing an invoice or installment purchase. Personal data that is necessary for the processing of the purchase contract and is associated with the respective order may also be exchanged. In particular, there may be an exchange of payment information such as bank details, card number, expiry date, and CVC code, quantity of items, item number, data on goods and services, prices and taxes, information on previous purchasing behavior, or other information regarding the financial situation of the data subject.

The transmission of data is particularly intended for identity verification, payment administration, and fraud prevention. The controller will transmit personal data to Klarna when there is a legitimate interest for the transmission. The personal data exchanged between Klarna and the controller will be transmitted to credit agencies by Klarna. This transmission is intended for identity and credit checks.

Klarna also shares personal data with affiliated companies (Klarna Group) and service providers or subcontractors to the extent necessary to fulfill contractual obligations or process the data on behalf of Klarna.

For the decision on the establishment, execution, or termination of a contractual relationship, Klarna collects and uses data and information about the data subject's previous payment behavior as well as probability values for their future behavior (known as scoring). The calculation of the scoring is carried out based on scientifically recognized mathematical and statistical methods.

The data subject has the option to revoke their consent to the handling of personal data at any time by contacting Klarna. Revoking consent does not affect personal data that must be processed, used, or transmitted for the (contractual) payment processing.

The applicable data protection provisions of Klarna can be accessed at https://cdn.klarna.com/1.0/shared/content/policy/data/en_en/data_protection.pdf.

We have integrated components of PayPal on this website. PayPal is an online payment service provider. Payments are processed through so-called PayPal accounts, which represent virtual personal or business accounts. Additionally, PayPal offers the option to process virtual payments through credit cards for users who do not have a PayPal account. A PayPal account is linked to an email address, which means there is no traditional account number. PayPal allows for initiating online payments to third parties or receiving payments. PayPal also acts as a trustee and provides buyer protection services. The European operating company of PayPal is PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal L-2449, Luxembourg.

If the data subject selects "PayPal" as the payment option during the ordering process on our online shop, data of the data subject will be automatically transmitted to PayPal. By selecting this payment option, the data subject agrees to the transmission of personal data required for payment processing.

The personal data transmitted to PayPal typically includes first name, last name, address, email address, IP address, telephone number, mobile phone number, or other data necessary for payment processing. Personal data related to the respective order is also necessary for the processing of the purchase contract. The transmission of data aims at payment processing and fraud prevention. The data controller will transmit personal data to PayPal, particularly if there is a legitimate interest for the transmission. Personal data exchanged between PayPal and the data controller may be transferred to credit reporting agencies by PayPal. This transmission is intended for identity and creditworthiness checks.

PayPal may disclose personal data to affiliated companies and service providers or subcontractors to the extent necessary to fulfill contractual obligations or process the data on behalf of PayPal.
The data subject has the possibility to revoke consent to the handling of personal data at any time vis-à-vis PayPal. Revoking consent does not affect personal data that must be processed, used, or transmitted for (contractual) payment processing.

17. Retargeting/Remarketing/Referral Advertising

In our online offering, we use the "Facebook Pixel" service provided by the following entity: Meta Platforms Ireland Limited, 4 Grand Canal Quay, Dublin 2, Ireland ("Facebook").

When a user clicks on one of our Facebook advertisements, the "Facebook Pixel" extends the URL of our linked page with a parameter. This URL parameter is then placed in the user's browser after redirection via a cookie set by our linked page.

This allows Facebook to define visitors to our online offering as a target audience for displaying ads (known as "Facebook Ads"). Accordingly, we utilize the service to display our Facebook Ads only to Facebook users who have shown interest in our online offering or exhibit specific characteristics (e.g., interests in certain topics or products, determined based on visited webpages) that we communicate to Facebook (referred to as "Custom Audiences").

Moreover, "Facebook Pixel" enables us to track whether users, after clicking on a Facebook advertisement, were redirected to our website and their actions there (known as "Conversion Tracking").

The data collected is anonymous and does not reveal user identities. However, Facebook stores and processes the data, potentially connecting it to user profiles, and may use the data for its advertising purposes.

All the processes described above, especially the setting of cookies to collect information on the user's device, only occur if you have provided us with your explicit consent according to Article 6(1)(a) of the General Data Protection Regulation (GDPR). You can withdraw your consent at any time for the future by disabling this service using the "Cookie Consent Tool" provided on the website.

We have signed a data processing agreement with the provider, ensuring the protection of our site visitors' data and prohibiting any unauthorized disclosure to third parties.

Typically, the information generated by Facebook is transmitted to and stored on a Facebook server, and there may also be a transfer to servers of Meta Platforms Inc. in the USA.

For data transfers to the USA, the provider adheres to the EU-US Data Privacy Framework, which, based on the European Commission's adequacy decision, ensures compliance with European data protection standards.

18 Rights of the data subject

The applicable data protection law grants you the following rights (rights of the data subject) in relation to the processing of your personal data by the controller, with reference to the respective legal basis for the exercise conditions:

Right to information pursuant to Art. 15 of the GDPR;
Right to rectification pursuant to Art. 16 of the GDPR;

Right to data portability pursuant to Art. 20 of the GDPR;
Right to withdraw consent at any time pursuant to Art. 7(3) of the GDPR;
Right to lodge a complaint with a supervisory authority pursuant to Art. 77 of the GDPR.

Right to object

If we process your personal data based on our overriding legitimate interests in the context of a balance of interests, you have the right to object to such processing at any time for reasons arising from your particular situation, with effect for the future.

If you exercise your right to object, we will cease processing the data subject to objection. However, further processing may be reserved if we can demonstrate compelling legitimate grounds for the processing that override your interests, fundamental rights, and freedoms, or if the processing serves the assertion, exercise, or defense of legal claims.

If your personal data is processed by us for the purpose of direct marketing, you have the right to object at any time to the processing of your personal data for the purpose of such advertising. You can exercise the right to object as described above.

If you exercise your right to object, we will cease processing the data subject to objection for direct marketing purposes.

19 Duration of storage of personal data

The duration of storage of personal data is determined based on the respective legal basis, the purpose of processing, and, if applicable, the respective legal retention period (e.g., commercial and tax retention periods).

When processing personal data based on explicit consent in accordance with Art. 6(1)(a) of the GDPR, the data in question will be stored until you revoke your consent.

If there are legal retention periods for data processed in the context of contractual or quasi-contractual obligations based on Art. 6(1)(b) of the GDPR, these data will be routinely deleted after the expiration of the retention periods, provided that they are no longer necessary for contract fulfillment or initiation and/or there is no legitimate interest on our part in continuing to store them.

When processing personal data based on Art. 6(1)(f) of the GDPR, these data will be stored until you exercise your right to object under Art. 21(1) of the GDPR, unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing is necessary for the establishment, exercise, or defense of legal claims.

When processing personal data for the purpose of direct marketing based on Art. 6(1)(f) of the GDPR, these data will be stored until you exercise your right to object under Art. 21(2) of the GDPR.
Unless otherwise specified in the other information provided in this statement regarding specific processing situations, stored personal data will be deleted when they are no longer necessary for the purposes for which they were collected or otherwise processed.
